  • Is a charge of VTL 509.1 and VTL 511.1A deemed to be a misdemeanor?

  • Dear moomjy-ga; Thank you for allowing me to answer your interesting question. According to the State of New York?s Division of Criminal Justice Services ?Unlicensed operation of a motor vehicle? (Vehicle & Traffic Law 509.1) and ?Aggravated unlicensed operation of a motor vehicle in the third degree? (Vehicle & Traffic Law 511.1A) are both deemed misdemeanors in the State of New York. DIVISION OF CRIMINAL JUSTICE SERVICES http://criminaljustice.state.ny.us/legalservices/programbill_s3418.htm 509.1 is a lesser offense to 511.1(a) ?Defendants who drive without a license but do not know (or have reason to know) that their driving privileges have been terminated commit a misdemeanor (Vehicle & Traffic Law 509 [1]).? NEW YORK COURT OF APPEALS http://www.law.cornell.edu/nyctap/I06_0035.htm ?Except as otherwise provided in this section, a person who violates the provisions of this section after having been convicted of a violation of this section shall be guilty of a misdemeanor punishable by a fine of not less than two hundred dollars and not more than five hundred dollars or a sentence of imprisonment for not more than one hundred eighty days, or both such fine and imprisonment.?
